POLÍTICA DE PRIVACIDAD

El Reglamento (UE) 2016/679 de protección de datos de carácter personal, establece un nuevo enfoque para el control y el tratamiento de los datos de carácter personal. Hemos revisado y adaptado nuestra política de privacidad a los nuevos requisitos y queremos ofrecer mayor información y transparencia en relación con el tratamiento de los datos personales.


1.- Información al Usuario

Vyra, SA, con CIF A07073109 es responsable del tratamiento de los datos de carácter personal de sus usuarios y clientes, así como de los datos que puedan ser recabados a través del sitio web.

Vyra, SA, informa a los usuarios del sitio web sobre su política respecto del tratamiento y protección de los datos de carácter personal de los usuarios y clientes que puedan ser recabados por la navegación o contratación de servicios a través de su sitio web https://www.royalplaza.es .

2. Finalidad del tratamiento de los datos.

Sus datos de carácter personal se recaban con la finalidad de prestar y mantener los servicios acordados contractualmente así como poder informarle sobre los nuevos productos.

El tratamiento de los datos que nos facilite a través de los formularios de la web , se regirá por esta misma política de privacidad. Las operaciones, gestiones y procedimientos técnicos que se realicen de forma automatizada o no automatizada y que posibiliten la recogida, el almacenamiento, la modificación, la transferencia y otras acciones sobre datos de carácter personal, tienen la consideración de tratamiento de datos personales. Vyra, SA, procederá a tratar los datos de carácter personal de manera lícita, leal, transparente, adecuada, pertinente, limitada, exacta y actualizada.

3. Datos recabados para la prestación de un servicio

Los datos de carácter personal que nos facilite para la prestación de un servicio serán los mínimos exigibles para poder elaborar el contrato así como para poder ofrecerle los servicios que usted contrate y para el cumplimiento de las obligaciones legales. Los datos serán conservados durante los plazos legalmente establecidos.

4. Datos recabados para la solicitud de información a través del formulario web. Los datos personales recabados a través del formulario web para la petición de información tienen como finalidad el envío de información comercial sobre nuestros productos y servicios.
El tratamiento de los datos en este caso está legitimado por el consentimiento expreso que usted nos presta al aceptar el envío de la información aportada a través del formulario.



5. Ejercicio de los derechos

De acuerdo con los derechos que confiere el Reglamento (UE) 2016/679 de protección de datos de carácter personal podrá ejercer los derechos de acceso, rectificación, limitación de tratamiento, supresión, portabilidad y oposición al tratamiento de sus datos dirigiendo su petición a la dirección postal indicada o al correo electrónico.

6. Destinatarios

Vyra, SA, informa a los usuarios de que sus datos personales no serán comunicados a terceros, con la salvedad de que dicha comunicación de datos este amparada en una obligación legal o cuando la prestación de un servicio implique la necesidad de una relación contractual con un encargado de tratamiento. En este último caso, los destinatarios de sus datos pueden ser empresas del grupo, empresas de solvencia patrimonial (en el caso de impagos, comunicados mediante los procedimientos y garantías establecidos por la normativa vigente) así como determinados encargados del tratamiento necesarios para la correcta prestación de los servicios.

Vyra, SA, mantiene unos criterios estrictos de selección de encargados de tratamiento y se compromete contractualmente con cada uno a cumplir y hacer cumplir las obligaciones establecidas en materia de protección de datos.

7. Variación de los datos Mientras no nos comuniquen lo contrario, entenderemos que los datos no han sido modificados y que usted se compromete a notificarnos cualquier variación.


8. Criterios de conservación de los datos Los datos personales proporcionados se conservarán hasta que no se solicite su suspensión por parte del interesado, ejerciendo sus derechos sobre los datos, y en cualquier caso en cumplimiento de plazos legales de prescripción que le resulten de aplicación.


9- Información facilitada por el usuario

Si eres menor de 18 años no está permitido el uso de formularios en nuestra web.
Los Usuarios, introduciendo sus datos en los formularios de contacto o presentados en formularios de descarga, aceptan expresamente y de forma libre e inequívoca, que sus datos son necesarios para atender su petición, por parte del Responsable, siendo voluntaria la inclusión de datos en los campos restantes. El Usuario garantiza que los datos personales facilitados son veraces y se hace responsable de comunicar cualquier modificación de los mismos. Todos los datos solicitados a través del sitio web son necesarios para la prestación de un servicio óptimo al Usuario. En caso de que no sean facilitados todos los datos, no se garantiza que la información y servicios que El Responsable le facilite, sean completamente ajustados a sus necesidades.

10. Medidas de seguridad

Que de conformidad con lo dispuesto en las normativas vigentes en materia de protección de datos personales, El Responsable está cumpliendo con todas las disposiciones de las normativas RGPD y LOPD para el tratamiento de los datos personales de su responsabilidad, los cuales son tratados de manera lícita, leal y transparente en relación con el interesado y adecuados, pertinentes y limitados a lo necesario en relación con los fines para los que son tratados. El Responsable garantiza que ha implementado políticas técnicas y organizativas apropiadas para aplicar las medidas de seguridad que establecen el RGPD y la LOPD con el fin de proteger los derechos y libertades de los Usuarios y les ha comunicado la información adecuada para que puedan ejercerlos.

11. Brechas de Seguridad El Responsable informará sobre cualquier brecha de seguridad que afecte a la base de datos que utiliza este sitio web, o que afecte a cualquiera de nuestros servicios de terceros, a todas y cada una de las personas, datos de los cuales puedan haber sido afectadas, y autoridades, dentro de las 72 horas siguientes a la detección de la brecha.

LEGISLACIÓN APLICABLE Y JURISDICCIÓN Para la resolución de todas las controversias o cuestiones relacionadas con el presente sitio web o de las actividades en él desarrolladas, será de aplicación la legislación española, a la que se someten expresamente las partes, siendo competentes para la resolución de todos los conflictos derivados o relacionados con su uso los Juzgados y Tribunales de Ibiza.

The processing of an on-line reservation through the website www.royalplaza.es implies that you are contracting a tourist lodging reservation, and it likewise implies the express acceptance of each and every one of the general conditions that are considered an integral part of the reservation and that are back by the specific applicable legislation. 

OWNERSHIP OF THE RESERVATION SYSTEM OF THE WEBSITE www.royalplaza.es:

The owner of the on-line reservation system of the website www.royalplaza.es is Vyra, S.A. (hereinafter HOTEL ROYAL PLAZA), holder of Fiscal Identification Code (CIF): A-07.073.109, with Registered Offices at C/ Pedro Francés, 27-29. 07800 Ibiza, Balearic Islands. Companies' Registry of the Balearic Islands, folio 50, of the volume 358 of the archive, book 287 of the 3rd section on Companies, page no. 6,648, 5th entry.

The use of the on-line reservation system by the visitor, hereinafter the USER (understanding as user the person who uses the reservation system of the website www.royalplaza.es) means that the USER assumes without any type of limitation the obligations set forth in these 'General Contracting Conditions' (hereinafter 'CONDITIONS' and the Conditions for use established in the Legal Notice).

The USER declares that he/she is of full age (that is, is at least 18 years of age) and has the legal capacity necessary to be bound by this agreement and to make a reservation according to the CONDITIONS established herein, that he/she expressly comprehends, understands and accepts in their entirety.

Therefore, the USER declares that all the information supplied by him/her to access this website and while using the reservation system, is true, complete and exact and promises to keep it up to date.

PRICES:

The prices applicable to the services are those in effect at the time of booking and can be checked in advance through the 'Reservations' section, under 'Rates'. Prices include VAT and are expressed in Euros. These are current prices, except in cases of typographical or computer errors, and may be subject to change without prior notice, without affecting reservations already made until the moment of the change. Prices shown on the website may differ from those provided by phone or other means. During June, July, August, and September, a deposit equivalent to one night's stay will be charged. For the rest of the year, credit card details are used only to guarantee the reservation. Some charges may be applied by the hotel at the time of booking, in accordance with the selected cancellation policy. Moreover, the cardholder must be the same person as the holder of the reservation.

SERVICES INCLUDED IN THE RESERVATION:

The price of the reservation includes lodging and the regime chosen for it: lodging and breakfast, half board or only lodging.

It does not include any other optional extra service or any other service that does not show expressly contracted through the website www.royalplaza.es.

The availability and the price of requests for special services such as the need of a crib, supplemental bed, etc., that was not included in the calculation of the online reservation, will be pending confirmation by the hotel.

As a general rule and unless otherwise agreed expressly, the rooms will be used from 15:00 hours of the day of arrival and must be left free before 12:00 hours of the day of departure. 

Upon making the reservation, the client is fully and exclusively responsible for the accuracy and veracity of all the information that he/she records. Verification of inaccuracy could provoke the annulment of the reservation.

Client's rights:

- Any information provided to the client shall have a binding nature for the offeror under the terms established by consumer protection laws. 

- Any user of the tourism services has the right for the goods and services that he/she acquires to be of the category and contracted legal requirements or of the quality that is in direct proportion to the category of the tourism establishment. 

- All the establishments have the obligation to have at the client's disposal the claim book in which to record his/her complaints. In order to formulate a complaint, ask for the corresponding form, fill it out with your personal information and indicate clearly the reason for the complaint.

Duties of the client: In the use of the contracted tourism services, each user has the following obligations:

- To pay the price of the contracted services, without the presentation of a complaint or claim exempting him/her from this obligation.

- To comply with the particular rules of the hotel establishment whose services the client uses.

- To observe the rules of hygiene, good manners and customs towards the other users and towards the hotel staff that provides the service.

Companies Registry of the Balearic Islands, folio 50, of volume 358 of the archive, book 287 of the 3rdsection on Companies, page no. 6,648, 5thentry, with CIF A-07073109, is the owner company of the website www.royalplaza.es.

HOTEL ROYAL PLAZA guarantees you the confidentiality of your personal information, as well as the use of the security measures, through technical and human means, as set forth in the Spanish regulations on the protection of data; necessary measures that guarantee the security of the information and avoid their alteration, loss, processing or unauthorized access, given the state of the technology, the nature of the stored information and the risks to which they are exposed. 

By using the online reservation system, upon being registered as a user, and by filling out his/her information in the 'Contact' section, the client authorizes the HOTEL ROYAL PLAZA to perform the automated processing of the personal information supplied, for the purpose of commercial management, in the case of requests for information or reservations.

No information that you provide to us will be shared with an organization or company outside the HOTEL ROYAL PLAZA.

HOTEL ROYAL PLAZA can reveal to the competent Public Authorities the personal information that it has, always following an official request according to the Law.

Pursuant to the Law 34/2002 on Information Society Services and Electronic Commerce, HOTEL ROYAL PLAZA informs you that your e-mail address will be incorporated to a distribution list for the purpose of proceeding to the sending of information, news, as well as for the realization of promotional and advertising activities of HOTEL ROYAL PLAZA.

The user can revoke at any time the consent given by sending an e-mail to: hotel@royalplaza.es

If you include, on any of the forms in the website, personal information owned by third parties, prior to their inclusion, you must obtain their consent and inform them of the points described above.

Unless otherwise specifically established, it will be considered necessary to fill out all the information required on the firms. In the case of not supplying all of the information deemed as necessary, Hotel Royal Plaza may not, depending on the case, register the user, or else deny the specific service requested.

The user must fill out the forms with true, accurate, complete and updated information, being liable for the damage and losses caused by the defective filling out of the forms with false, inaccurate, incomplete or out-of-date information.

If you are a minor, it is required that you have the prior consent of your parents or guardians before proceeding to the inclusion of your personal information in the forms of the website.

USE OF COOKIES:

HOTEL ROYAL PLAZA informs the users, through this notice, that it uses cookies when the user navigates through the different screens of the website.

Cookies are small files used by the company that are stored in the user's hard drive but that cannot read the data contained in it or read the cookie files created by other suppliers. Nevertheless, the user can impede the generation of cookies by means of selecting the corresponding option in its navigating program.

INVALIDITY AND PARTIAL NULLITY:

Should one or several of the clauses included in these general conditions be declared totally or partially void or inapplicable (in its entirety or in part) by any Court, Tribunal or competent administrative organization, this nullity or inapplicability will not affect the other general conditions or the conditions for use, which will preserve all their validity.

APPLICABLE LEGAL SYSTEM AND JURISDICTION:

The website of HOTEL ROYAL PLAZA is governed by Spanish legislation and is under the jurisdiction of the Judges and Courts of Spain.

In general, the relations between HOTEL ROYAL PLAZA and its users and clients, derived from the contracting of the products and services contained in this website or in the conditions established for the proper use thereof, will be governed by Spanish laws and under the jurisdiction of the Courts of Ibiza, with express waiver of the jurisdiction that might correspond to them.
